First...it's not legal at 12. It's legal for them to BUY at 12. What you buy for your kids to play at home is your business. As long as it's not hard alcohol or actual hardcore pornography. Hell, you can legally give your children small amounts of beer and wine, as long as they do not become overly intoxicated. This isn't that much different.
The video mentions that they don't actually use the controller. Another video I see that actually shows gameplay? shows that the controller is necessary. It's using the motion sensor to detect movement of the players.
Is it a little racy for what people WISH their kids were doing? Sure. Is it any worse than what your average twelve year old who's even remotely social is getting up to? Hell no. It's nothing but party games. It's like truth or dare, or spin the bottle, for the modern generation.
